Rooks Park – A family outing at a Washington state park turned into every parent’s worst nightmare when a three-year-old boy was killed after a large stone monument toppled over and crushed him in a matter of seconds.
The boy’s parents have now filed a lawsuit against several companies involved in building and installing the structure.
Monument Falls in Seconds at Rooks Park, Crushing a Young Boy
Kaleb Ortega was at Rooks Park in Walla Walla on April 1 with his father, Miguel Ortega, and his five-year-old sister when the tragedy occurred.
According to the lawsuit filed by his parents, the monument, which honored US Naval Captain Albert H. Rooks and the USS Houston CA 30, was excessively heavy and lacked proper support. The suit claims the structure fell within seconds and crushed Kaleb before anyone could react.
First responders rushed to the scene and transported the young boy to the hospital, but he later died from his injuries. What made the tragedy even more devastating for the family is that Kaleb’s mother, Claudia Garcia, works as a nurse at that very hospital.
She was on shift when her son arrived by ambulance and witnessed the desperate efforts to save his life firsthand. The lawsuit states that this experience caused her severe emotional trauma that the family is still grappling with.
Family Seeks Justice as Community Mourns a Joyful Little Boy
The lawsuit, filed in Walla Walla County Superior Court, names several companies as defendants, including Boulder Designs, Boulder Designs Franchising LLC, Border Magic, Builders FirstSource Inc, American Rock Products, Wenzel Nursery, Double T Construction Ltd, and Neil Binder along with the Binder marital community.
The family alleges negligence in the design, construction, and installation of the monument and argues that park visitors should have been warned about the potential danger it posed. None of the defendants has filed a response to the lawsuit as of yet.
In the wake of Kaleb’s death, a GoFundMe page was created to support the grieving family. The page describes how an ordinary, happy day filled with play turned into an unimaginable tragedy that took Kaleb from his family far too soon.
Loved ones wrote that no one could have anticipated the heartbreak that followed.
Kaleb was remembered as a joyful and busy little boy who filled every moment with life. Family members said he was always on the move and happiest when he was playing or exploring, especially alongside his big sister, whom he considered his best friend.
The siblings reportedly spent hours together laughing and playing, creating memories the family says they will hold onto forever.
The tribute page also highlighted Kaleb’s love for monster trucks, noting that he took great pride in his collection and would carefully line up his toys every night before bed. Those who knew him described his smile and bright eyes as something that could light up an entire room.
The US Army Corps of Engineers, which operates Rooks Park, closed the site for two weeks following the incident and fenced off the area where the monument once stood. The monument has since been removed entirely from the park.
The family is now seeking damages for wrongful death as well as the emotional distress suffered by Kaleb’s parents and his young sister, who witnessed the horrifying accident firsthand.
